Pre-commencement of work

Excavator work to be carried out by a Little Digger Hire operator

The Little Digger Hire operator will carry out work in accordance with the Customer’s instructions. Any advice given is purely as advice and is not binding.

All underground services must be identified by the Customer prior to any work commencing. Any disruption or damage to underground services is the liability of the Customer.

Any protection to grass or landscapes must be requested prior to the commencement of work. All materials associated in ground protection will be charged for.

Little Digger Hire shall be entitled to rely on the accuracy of any plans, specifications and other information provided by the Customer. The Customer acknowledges and agrees that in the event that any of this information provided by the Customer is inaccurate, Little Digger Hire accepts no responsibility for any loss, damages, or costs resulting from these inaccurate plans, specifications or other information. The Customer acknowledges that it has sole liability for, and indemnifies the Little Digger Hire operator against:

A) Any costs as a result of the actions of any sub-contractors employed by the Customer

B) Any extended work as a result of, but not limited to, underground obstacles, the characteristics of the land and adverse weather.

Where the Little Digger Hire Operator has followed instructions given by the Customer, the Customer shall indemnify the Little Digger Hire operator against all damages, penalties and costs as a result of following the instructions provided by the customer.
